Terms and Conditions

These Terms and Conditions apply to all transactions. Please read them carefully. They do not affect your statutory rights. We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on to the site (see date above).



Our Contract

We try very hard to ensure that all information on this site is accurate. However, just occasionally, an error can occur. If we discover an error (e.g. the price or description of a product you have ordered) and a suitable alternative cannot be agreed, we may cancel your order at any time up to the point we send you the product(s) (even if you have received your Order Confirmation). If we do cancel your order, you will receive a full refund of any charges already paid.



Prices and Payment

All goods remain the property of Miners Home Appliances until invoices are paid in full. Invoices not cleared within 30 days will incur an interest charge of 2.5%. All prices and charges on this site are in UK pounds. They include any VAT payable, but exclude delivery charges. The total cost of your order will be the price of the products you order, the applicable delivery charge (if any) plus any additional services you choose e.g. Connection ( gas products to be connected by a suitably qualified and approved engineer, this charge may be invoiced by an outside contractor, as Miners Home Appliances do not carry out any gas connections or testing). Built in Appliances will be connected and installed, this excludes the refitting of door furniture and any alterations to kitchen cabinets, if instructed to carry out this service at the time of installation a charge will be invoiced at our normal hourly rate. Prices, offers and products are subject to availability and may change before, but not after, we confirm your order. If something becomes unavailable we may offer you an alternative. We accept payment by most major credit and debit cards.



Where We Deliver

Small Items

For smaller items delivery is to addresses in the United Kingdom only.

Large items

We can deliver all large items to any Location within Southeast Cornwall.

Delivery Charges

Delivery is FREE for any appliance over £150 (final price paid, not before Sale discounts or promotions) within Southeast Cornwall. Products of a lower value than £150 will be charged at £5.00 for 1 man delivery or £10 for 2 man deliveries. Small Appliances or Spare Parts sent will be charged at the appropriate rate depending on weight and size and type of courier or postal service requested, goods will not be released until full payment has been received and funds cleared.



How We Deliver

Smaller products are generally delivered either by courier or by post. If your product is one which is delivered by courier, you may be given the option of choosing a premium delivery service for a small extra charge during the order process. Cookers, fridge/freezers, washing machines, dryers, dishwashers, plasma TVs, some large screen TVs and similar items are generally delivered by our own delivery team. For these larger products you will be asked or told about delivery dates for standard delivery as part of the order process.



Delivery Times

For certain goods we will specify an “expected delivery date”. Small Products – Standard Courier Delivery For small products our standard delivery is Monday to Friday (excluding Bank Holidays generally from 9am to 5pm, and we aim to get your purchase to you within 3 working days if you order before 12.00pm or 4 days for all orders after 12.00 pm. For extended Bank Holiday periods such as Christmas and Easter please allow 4-7 working days.



Tracking Your Order

If your order is being delivered by courier you can track your parcel by visiting the appropriate web site please ask sales staff for details when placing order. All deliveries must be signed for. If you are out when the courier arrives, the courier will leave a card with a contact number for you to call. If your item is being delivered by Royal Mail you will be unable to track the delivery but should expect your order in the post within the next few days after your order is placed.



Our Home Delivery Service

Delivery is Monday till Saturday, usually from 9.00am to 5.30pm and we aim to get your purchase to you within 4 working days. You will be allocated a 4 hour delivery time window. It is also very important to give two good contact numbers as our drivers may contact you ½ hour before the delivery is due to take place. IMPORTANT: We do everything we can to meet the delivery times specified in this section. However, these cannot be guaranteed as occasionally delivery times may be affected by factors beyond our control.



Installation

We offer a high quality and efficient installation service for many large household items. If installation is available, you will be offered it as part of the order process. It is subject to additional terms and conditions which you must read before you order, the service includes:


     • Your product unpacked and checked.
     • Your old appliance will be disconnected when we arrive.
     • Product positioned and set up for you, and our engineer will carry out a function test.
     • Your old product can be taken away and recycled free of charge, this will be on a day when our agent is in your area or         alternatively you can drop the product off yourself to Miners Home Appliances at a time more convenient to yourself free of charge. If this is not suitable we can allocate a space on our delivery van to carry your old product away on the same day as delivery of your new item, but this may incur a charge of up to £15 depending on unit size and weight.

Our installation charges are in addition to any delivery charges.



Disconnection

Gas and dual fuel cookers must be disconnected by a Gas Safe registered engineer and mains wired electric cookers should only be disconnected by an electrically competent person.



Scrap Collection

For many larger products we offer to remove your old appliance for free. If scrap collection is available you will be offered it as part of the order process. IMPORTANT: Your old appliance must be empty. Fridges and freezers must be fully defrosted.



Missing, Damaged or Incorrect Orders

We try very hard to ensure that you receive your order in pristine condition. If any of your products ordered are missing, damaged or incomplete please ensure that this is noted on the delivery person’s paperwork before he leaves. We may be unable to accept responsibility for any of the above if you have signed for or accepted the goods without noting any problems on the delivery person’s paperwork.



Returns and After Sales Policy

Your product must be complete and in ''as new'' condition. If you have opened the box to examine the product you must have done so without damaging or marking the product or packaging. The product must not have been used or installed and data must not have been inputted. It should be returned with the original box and packaging, along with any accessories you received with it. DVDs, CDs, memory cards and software must still be sealed. Any free gifts received with the product must also be returned. If you follow the above, we will issue you with a full refund for the cost of the product. However we reserve the right to retain any charge paid for services which have already begun or been completed. Refunds take 3-5 working days to be credited to your payment card. Whilst the goods are in your possession you must take reasonable care of them and not use them. We cannot cancel your purchase when:

     • there is a contract for services with the product and you have started using the services; this would include, for example, a mobile phone subscription
     • the seal has been broken on any DVDs, CDs, memory cards or software, including games, or on any personal hygiene products such as shavers
     • the goods were a special order to your specification



Under Guarantee Call Out Charges

If a service call has been booked for a product within its guarantee period and it is proven that there is no fault, example, problem solved by retune, operator error or misuse, our standard call out charge will be invoiced.



Faulty goods

The following are guidelines for all goods ordered for delivery. Wherever possible we will respond to your individual circumstances. If there is a fault with your product within the applicable product guarantee period (normally 12 months from delivery) or other defect with your order, we will normally offer a prompt repair service. You will always have the option of an exchange or refund if the fault occurs within 28 days of delivery. In all cases we reserve the right to inspect the product and verify the fault. To qualify for a refund or exchange the product must be:

     • in otherwise ''as new'' condition
     • complete with any accessories and free gifts offered with it if possible, with the original box and packaging

If a DVD, CD, or software item is faulty under guarantee we will happily exchange it for the same title or offer a refund. You can phone for Service advice on 01579 343410 Monday to Saturday, from 9am to 5pm,. Any refund due to a fault or other defect will include a refund of the applicable delivery charge paid (if any) but excludes installation costs. In these cases, we will also pay for our costs of collecting. Replacement goods are sent by the standard delivery. This promise does not cover faults caused by accident, neglect, misuse or normal wear and tear. Consumable items, such as belts, batteries or door gaskets are not covered. Items sold are generally intended for normal domestic and consumer use and not for resale or commercial use. If we arrange to collect goods from you it will be at our cost.


THIS RETURNS POLICY DOES NOT AFFECT YOUR LEGAL RIGHTS. DETAILS OF YOUR LEGAL RIGHTS ARE AVAILABLE FROM TRADING STANDARDS OR CONSUMER DIRECT.

Miners Home Appliances and our suppliers own the copyright, trademarks and all other intellectual property rights in all material and content on this website, which you may use, download, copy, publish, transmit or otherwise make available by any other means only for your own personal, non-commercial use. Any other use or reproduction of the material or content is strictly prohibited. You may not create any link to this website without our prior written consent, nor may you restrict or inhibit the use or enjoyment of it by anyone else.



General

These terms and conditions, and all transactions relating to this website and all non-contractual obligations arising from any transaction carried out on this website are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions. Additional terms and conditions may apply for prize competitions and our added value services and offers. If so, you will be alerted to them at the relevant juncture. These terms and conditions apply to Miners Home Appliances and this website, we accept no responsibility for associated or linked sites as they will contain their own terms and conditions.



Privacy Policy

This website has been designed purely as an advertising site, no information will be collected or stored unless required for warranty purposes, any information passed to us by email or telephone, will only be stored by Miners Home Appliances for the purpose of warranty records. The only instance where information will be forwarded is in the event of a product being purchased requiring a TV licence; this information will be forwarded to TVLA and no other party. No information is stored in relation to payment detail.
